Indian company: Tax payment to their onsite employees

Hi ,

I work for a Indian Company and for the past 15 months they have placed me in a client role in UK.
My Employer pays my bank account only the Net pay. They sort out all the taxes and they do not inform how much of taxes are being paid.
I dont have P45 or PI or NI number.
Several request to my employer has not yielded proper result.

Any advice on this regard in getting tax papers and also in knowing the gross pay. These will help me to apply for HSMP.

Offshore companies, bring employees on a WP and pay them an allowance and a minimal salary. They dont pay TDS (tax deducted at source). They use a feature called Blanket Tax, where in they pay income tax for all employees onsite once in 2 years. I am not sure about the intricate details. Does any one else know?

Hi

Your employer has a legal obligation to give you
- Payslips showing Gross Pay, Tax/Ni decucted, and Net pay
- a P60 at the end of the tax year (each April)
- A p45 when/if you leave their employment

If they are not cooperative, perhaps because they do not want their guys getting the freedom of HSMP, it can be difficult. Especially as an employer can provide online payslips but refuse to give staff copies that have been signed / stamped by the company as required under HSMP validation rules.

In extreme cases people sometimes end up moving to a new WP sponsored by a friendly company that will co-operate with the employee's HSMP plans.

Hi James,
Even I have the same situation. My indian company is paying the tax and NI and I dont have a clue and I cant ask them for details as it will jeopardise my further stay here. and I only get online payslips which may not be useful without sign and seal. But my workpermit has the gross salary though and my net when calculated is exactly 33% less than what is shown on work permit implying 22% tax and 11% NI.
would that be sufficient proof If I have to apply for hsmp?

Unless you show UK payslip (with NI & tax deduction) you won't get HSMP!
In that case, rather use your Indian salary.

And nowadays, getting HSMP is no longer a gift - it may soon turn as tragedy.
