how to get divorced

Post by joleneh » Tue Jan 04, 2011 10:07 am

Hi. I married my husband in a Southern Irish Registry office in sep 2003. We are both English Citizens but he lived there with his parents (who are Irish) for a short period prior to the marriage so that we may marry in Ireland. We separated in october 2009. He moved out and we have been living separately. Do we have to seek an Irish Diviorce because from what i have read you need to be living there to do so?! Can you help?

If you are living in another country, which it sounds like you are, you can apply for a divorce under local laws, so long as you plan to stay there. For example, if you wanted to move back to Ireland, you'd have to apply for divorce here.
This is what I understand the law to be, anyway. I'm non-EU and want a divorce from an Irish person, but since I'm still living here, I have to abide by Ireland's crappy divorce law, rather than looking for a faster one back home, so I think you should be ok to get one in England.
