Redundancy and Working queries

Post by Jiddu » Mon Dec 04, 2023 3:48 pm

Hi

Jiddu here, I had critical skills employment permit and due to redundancy it was cancelled. I informed the same to GNIB and I was issued a new STAMP 1 for a period of six months to secure a new job and apply for a new permit. This STAMP 1 is not linked to the cancelled employment permit.

So the question I have is can I start working using the current STAMP 1 as it is not linked with my old cancelled permit and then apply for a new permit after joining the company?

Thank you in advance.

What does it say in the letter you were given by ISD when you applied for this stamp?
It usually says in the letter "without the need for employment permit" - if that's the case, you can do it.

STAMP 1 permission is generally issued when you have a permit or hosting agreement. But in my case it was issued even though I didn't have a valid permit and my case was redundancy. So that is why I am confused.

Did you get a letter from ISD allowing you to get it?

Here's what I mean (picture from the internet) - if you have the phrase underlined, you can work without the permit.

You, obviously, need to get a new one ASAP.

Yes I can understand, but in your case it is mentioned as an exceptional case where as in mine I have permission to stay in Ireland for 6 months after my redundancy and to secure a job and apply for a permit. I haven't applied for this letter as I automatically have permission to stay in Ireland and the GNIB allocated a STAMP 1 for that period of 6 months.

And I got a permission as mentioned below

Dear Sir,
I confirm that (due to Redundancy) your Employment Permit has now been cancelled. The Employment Permits Section of the Department of Enterprise, Trade & Employment having been notified of the redundancy, you now have up to six months from the date on which you were
made redundant to find another job.

If you cannot find another job within six months of being made redundant you should contact the Irish Naturalisation and Immigration Service to establish your immigration status beyond that period. Should you opt to leave the country, and you are later successful in getting another job offer in Ireland, you may apply for a new employment permit if you are eligible at that time.

And based on this I got my STAMP 1 for six months.

Then it might not be so clear cut. The sources I see (official ones) are only telling about finding a new job, not working.

My advice would be to send an email to ISD/DETE asking this question (or even a paper mail, if no response) to see what they say.
