Non-EU divorcing EU citizen on settled status

Post by Edu102 » Sun Dec 22, 2024 1:14 pm

Hello everyone,

Thank you for your time and help.

I am a non-eu citizen with settled status in the UK. My status was granted in 2021.

My relationship with my EU wife broke down early 2022 after being and living together since 2016 (the year we got married, we got married in UK) We haven’t lived together since then.

We have now taken the steps to get a divorce and the application has been accepted by the court.

Now, my questions are:

Will my Settled Status be affected by the divorce?
Will I have to reapply for settled status based on Retained Rights after the divorce has been concluded?
Do I have to inform the HO when we are finally divorced?

From what I’ve understood my status won’t be affected in anyway and I don’t have to notify the HO since my status is not dependent on my relationship. However, my online UKVI profile establishes that the legal basis of my status is being a family member of an EU citizen which, in a couple of months, I will no longer be.

Thank you

Settled Status is equal to ILR and it means you don't have any immigration restrictions, including any dependency on someone. So no need to worry about. SS can be affected only if you commit some serious crime, so in this case it can be revoked.
