Paid for 42 hours, required to work 37 hours. Am I eligible for sponsorship??

Hello,

I am currently working for a company which is ready to sponsor me but they are saying I don't meet the threshold.

My contract says “ You will be paid for 42 hours per week. You will be required to work 37 hours per week after any daily lunch break.”

The gov UK says the salary(39900)mentioned in their site to meet the threshold is for 37.5 hr working week.

My employer is saying that we need to pro rate for 42 hours which will be 45k as the threshold to meet. I dont meet that(42000).

But my employer still used 37 as weekly working hours on all the CoS’s he/she issued until now.


What should I do now ? Is the calculation they are doing right ?? Am I eligible ?
