PBS dependant extension route while main applicant is pending decision on SET(LR)

Hi Forum,

I am currently on a Skilled worker visa expiring early Jan'25 and my wife is on PBS dependant with same expiry(since Oct'23 and will be eligible for ILR in Apr'28 via 10 year route as she first entered UK in Apr'18) .I also have a child born in the UK in Apr'24 and I am planning to register my child via MN1 once I receive my ILR.

I have applied for ILR under long residence - set(LR) and I am currently awaiting decision on the same. My timeline thread is posted https://www.immigrationboards.com/viewt ... 0#p2181411.

My question is on my wife's extension and child's MN1 registration.
1. Can my wife extend her PBS dependant whilst I am awaiting decision on my ILR ? Or does she need to apply via Family Visa as a partner route since my ILR application was on the basis of Long Residence (10 years) and not Skilled worker route (5 years).
If its via Family Visa route, can she submit her application now providing a cover letter that the main applicant ILR is pending to avoid waiting time ?

2. Can I apply for my child's MN1 application now whilst I wait for my ILR decision or will it get rejected ?

2. Can I apply for my child's MN1 application now whilst I wait for my ILR decision or will it get rejected ? It would be rejected. You have to wait.

Your wife can continue to extend her skilled worker dependent visa. It is a 3 year extension. She should apply before her current visa expires. If you don't have ilr when she applies, her application will be held until your ilr is processed and completed.

She doesn't have to switch visa categories.

Will she able to apply an extension for another 3 years after the current extension as she will still be short of few months on both 10 year as well as 5 years

Does anyone one know if there is a limit on how many times a pbs dependant via skilled route can apply an extension for ?

There is no limit.

Anybody knows what does complex case due to European Convention on Human rights means ?

Really worried about the outcome now.
Could it be because I answered the below question instead of answering as No :
Do you have any other reasons for wanting to stay in the UK ?

My response was :
My wife and I have recently become parents and we would very much like him to
grow up and have a quality education in the UK as
we both have loved living, working in the UK and
experience the life and culture that UK has to offer.

Maybe I am just overthinking.

Please advise .

We can not tell you the reason why and most definitely other people had answered that same question and it did not result in ECHR response from HO.

Update :

Decision was successful on 18th Nov'2024.
Additional information was asked which was All pages of my old passport.
So the wording on European human rights was nothing to do with the delay.
