Query Regarding Tier 2 Skilled Worker Visa and Duration of Stay Outside the UK

Post by Nivemukr » Fri May 03, 2024 11:13 am

Hello everyone,

I have a query regarding the duration of stay outside the UK for individuals holding a Tier 2 Skilled Worker Visa.

I currently hold a Tier 2 Skilled Worker Visa, which is set to expire in March 2026. I am currently in India for vacation. I would like to inquire if there are any regulations specifying a maximum duration for staying outside the UK, such as a requirement to return within 180 days.

Your insights and guidance on this matter would be greatly appreciated.

If you are “working from home” but actually overseas that is a technical breach of the employers sponsor duties. Less of an issue for you but potentially an issue for the university.
If an employee is absent from the U.K. for 28 days or more in a continuous period such as “working from home” but abroad then the employer should be reporting that fact under the change of work location.
In those circumstances the visa should be pushed to cancellation. Do employers report this, rarely if ever.
