1) Child Benefit: As far as I know you ARE eligible to apply for child benefit, on the basis that you dont have any visa restrictions now. My gut instinct response would be no since its not easy to prove they HAVENT been tampered with, if you see my point. It seems the child will have valid leave, since s/he entered with their mother who apparently has valid leave till next year. So as soon as the father receives his settlement the child qualifies for citizenship. I see your point of child not being born here though, so it might indeed be complicated ...

Wouldnt it be more sensible to not apply for any visa for the child and then apply for citizenship for the child as soon as you've got your ILR? It'll work out cheaper as well.

Thanks a lot for your help Amber! I went to Cardiff PEO today and my wife's application for Settlement was approved! Hurray!! You do NOT have to declare anything about your child. You only have to declare people you want to get visas for. My friend who has two children and is about to qualify for ILR wont declare either of his children on his SET(o) and will directly apply for their Citizenship, which should save him a ...

Tier1G09, You can absolutely apply after waiting several months, which is what I did. I only applied for my daughter's citizenship after she was like 10 months old. They do charge a £100 appointment fee although that's only lost if you miss your appointment without a valid reason. So it's possible the change may not cost you anything.

As mentioned above, he is in breach of his visa conditions and subject to removal. What he can do to avoid it is not include his National Insurance number on his ILR application, since that is the only thing tying him to his earnings and something that the Home Office can check.
