Re: RLMT for Hiring a Tier 4 student required ?

28.8 You do not have to conduct a resident labour market test if a migrant you want to sponsor is applying for Tier 2 (General) leave in the UK and has, or was last granted leave to enter, or to stay in the UK under one of the following: a)Tier 1 (Post-study work) b)Tier 1 (Graduate Entrepreneur) c ...

Re: TIER 2 35000 requirement - all five years or 5th year on

Correction: forgive me, although not currently the rule, from 6 april 2016 the ilr requirement will be.. 35000 or the appropriate rate in your job code, whichever is higher. To answer the op's question then, it doesn't seem clear yet, but this applies at the time of the application for ilr. So most ...

Re: TIER 2 35000 requirement - all five years or 5th year on

As far as I know there is no set figure for Tier 2 ILR applications. The requirement is that you are paid at the appropriate rate for your job, so this will depend on which Code your job falls under. For ILR applications, the appropriate rate will be the experienced rate. This is because you will ...

Re: CoS in August 2014

Anyone gets approved CoS in the recent meeting (11th August 2014) of UKBA? Yes If the request is approved, then you normally find out on the same day (i.e. the 11th of the month). The panel meets on the 11th of each month (if a weekday, otherwise the following Monday I think?), which means that ...

Re: Restricted vs Unrestricted CoS

If there's good advice to be taken from this thread, it is not to assume that your employer has it all covered. Insist on getting a printout of your CoS, and make sure everything matches up exactly in your application. And even send it with your other documents. Otherwise you risk losing money and ...

Re: Query on Applying for ILR

Thanks manci. So it's a little bit tricky to say without further info. The way I read it, it depends on whether and when (and where!) the Tier 2 ICT visa expired, before the date the Tier 2 General leave was granted. If it expired outside of the UK, then the application would have to be made no ...

I suspect your solicitor may have been talking about the investment. You can't rely on any money spent by the business over 12 months ago for the purposes of meeting the £50k requirement.

Re: Tier 2 General Salary for job code 2136

If you are under 26 you can be paid at the new entrant rate. Also, FYI whether your salary meets the appropriate rate will depend on the weekly hours that are in your contract. For example, if your contract says 30 hours then it meets the minimum appropriate rate. BTW technically, until Appendix A ...

Re: Apply for T2 out of country with valid Tier 4 ?

I don't see why it should be a problem but if you are worried then you can explain this on the last page of the online form or in a letter. They will see straightaway that you are currently on Tier 4, so just explain it clearly. Btw, if your current Tier 4 visa was an extension after a different ...

Re: Employer Sponsorship Suspension Queries

Just to add to what manci has said, I think you can check the register of sponsors and see if a sponsor is B rated: https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/341821/Tiers_2___5_Register_of_Sponsors_2014-08-07.pdf B rating is a temporary rating given while an employer ...

Re: Restricted vs Unrestricted CoS

Unless you will be earning over £153,500 a year, or you are a Croation national, I think you will need a restricted CoS.

However, it sounds more like your sponsor doesn't know what it is doing, as the others have suggested.

Good luck!

Re: Tier 2 General sponsorship Query

AFAIK if your sponsor stops sponsoring you, the UKVI will curtail your visa to 60 days. As physicskate says, your story sounds strange. Sponsors should not behave in this way - they are supposed to be hiring you to fill a genuine vacancy. If there is no such vacancy, then you should look for a ...

Tier 1 Entrepreneur? If you can free up £200k and can make a serious business plan, drawing on your qualifications and experience, then you would be eligible for this visa. You don't need to submit maintenance evidence. Just tick the Tier 2 General Migrant box in the form, same as for the English language evidence. I would recommend asking your employer for a printout of your CoS. Make sure that everything on the CoS matches exactly with the application form ...
