Re: UK Spouse visa refused. Reapply under Irish?

Apologies, I respect that!
What's an SS related topic then?

I'm assuming many people have been in similar circumstances.

My question therefore would now be if I move to Ireland can he join me and if so how?

Or/and do I really need to move to Ireland if I can obtain an Irish passport?

UK Spouse visa refused. Reapply under Irish?

Hi all, I would really appreciate some advice. My case is a bit complex but I will try to simplify. I'm English, born in the UK to Irish parents. (I am entitled to an Irish passport). I'm married to an Albanian guy. We have been married over one year. We married in Albania in Sept 2015. And this is ...

Re: Spouse visa and entry clearance with criminal record

Hi Guys, an update. He did cancel. He withdrew the application unbeknown to me!
Great news eh? Waste of time and money.
But he has another girl in Italy and is on his way to her now, maybe to marry and apply for an EU permit.
Oh well, we live and learn or so they say.
Merry Xmas to you all.

COULD THE VISA HAVE BEEN CANCELLED OR REFUSED?

Hi All, My Albanian husband applied for a spouse visa from Albania to join me in the Uk only 2 weeks ago. I suspect he has cancelled the application because I received an email from the Tls site saying application has been assessed and decided and docs would be returned within a couple of days. He ...

Re: Spouse visa and entry clearance with criminal record

No one can say for sure whether he cancelled the application, but it does seem that the NHS surcharge is often refunded before the letter of refusal and documents are received. If it has been cancelled, unfortunately the application fee + the NHS surcharge will be lost. However, cancellation doesn ...

Re: Spouse visa and entry clearance with criminal record

I think you need to speak to this guy. The conclusions you are making are quite problematic in the absence of tangible evidence. Ask him. I have asked him. He saying he didn't cancel it but a few days before I received email saying application had been assessed he was asking for the reference ...

Re: UK SPOUSE VISA REFUSED TO NON EU BY UK, APPLY AS IRISH??

The prospect of auccess are significantly higher under the EU law point. That is as far as I can go. Very good prospect. If it went as far as appeal the prospect is even higher. I think it is a bit extreme, do you not, to suggest his inability to come in will lead to the end of your marriage? How ...

Re: UK SPOUSE VISA REFUSED TO NON EU BY UK, APPLY AS IRISH??

If you renounce British Citizenship, then the possibility of a refusal on the basis of his criminal conviction alone, is limited. Limited? What do you mean? You mean likely? Can they refuse an EEA permit for criminal convictions? Could a refusal be overturned on appeal under HR Article 8? Is that ...

Re: UK SPOUSE VISA REFUSED TO NON EU BY UK, APPLY AS IRISH??

As I said in my previous reply to you on another thread, your husband's visa is likely to get refused. As funny as it sounds, I don't know if Surinder sing will apply. Although it can be argued, that the UK cannot have it both ways. Thanks for answers. Do you think an EEA family permit be refused ...

Re: Spouse visa and entry clearance with criminal record

Difficult. Refusal under 320(2)(d) or 320(11) possible. Have you considered moving with him and working in another EEA country? Thanks Vinny. This is what I am scared of. The solicitor gave a 50/50 chance. I have considered perhaps moving to Ireland. Both my parents are Irish so I am entitled to an ...

Re: Spouse visa and entry clearance with criminal record

I'm sorry I have no advice for you. But I wanted to say I really feel for you. I have recently married an Albanian man and going through the same struggle. However we are lucky he is in the UK and he was never prosecuted for a bad quality id. I wish you the best of luck and hope it works out. Malik ...

Re: Illegal immigrant

They should be careful. Once they register the marriage here the Home Office are made aware and even if they don't detain him they will know he is around and could do so at anytime. Even if they marry here he cannot legalise his status unless he applies for spouse visa from outside the UK, in other ...

Spouse visa and entry clearance with criminal record

Hello All, Please can anyone give me some advice. Its a long story but the basis of it is this: I am a British Citizen living in London, UK. I met my Albanian partner here in October 2012 and soon after he moved in with me. He was an illegal entrant to the UK, a clandestine entrant and had not ...
