ILR As Partner of Tier 2 Holder Who Settled

Hi all, I believe I am eligible to apply to settle in the UK as the partner of a Tier 2 holder who has settled in the UK (as my husband just recently received his ILR). However, I'm slightly confused about the eligibility criteria, specifically the "You must have been living with your partner in the ...

Re: ILR Applicant With Tier 2 Dependent

Sorry - after doing some research, it looks like I may be eligible to apply to settle in the UK as the partner of a tier 2 holder who has settled in the UK (if he gets it). First, is this visa the ILR? Second, I'm slightly confused about the eligibility criteria, specifically the "You must have been ...

Re: ILR Applicant With Tier 2 Dependent

Yes, he's planning on doing the premium service & his visa expires the same time mine does.

ILR Applicant With Tier 2 Dependent

Hi all, My husband is eligible for the ILR in a few months through the 5 year route. I'm currently on a Tier 2 General Dependent visa based off his current visa, which is set to expire in May. I was wondering - am I able to renew my Tier 2 Dependent visa with his ILR application, or do I have to ...

Citizenship Of Child Born To ILR Parent

This is just a hypothetical question, as my husband & I are researching the best time to start our family. My husband currently has ILR while I am still on a Tier 2 Dependent visa. If we were to have a baby while my husband was still on ILR, would the baby be considered a British citizen or would we ...

Re: ILR 10 Year Absence Rule

Correct. When did you wife APPLY for her initial (first) PBS dep visa and when did she first ENTER the UK? She first applied for her PBS dep visa earlier this year - in Mar/April 2016. She first entered the UK in 2013 on a student visa, then she was on a Tier2 visa for work before switching to the ...

Re: ILR 10 Year Absence Rule

But if I wait & apply for ILR via the 5 year route, my spouse won't have to switch, correct? And can use the time on the PBS dependent they currently are on towards their own 5 year ILR period?

Re: ILR 10 Year Absence Rule

Yeah I agree - I do really want to get my ILR as soon as possible, but it does seem that waiting for the 5 year track is more sensible. I just wanted to confirm my suspicions about the absences on here - I've also heard that trying to get the ILR via the 10 year track is much harder than via the 5 ...

Re: ILR 10 Year Absence Rule

Thanks for the reply CR001 - so the HO don't make exceptions for days outside the UK if in total you exceed the absences limit no matter what the reasons for leaving the country are?

Re: ILR 10 Year Absence Rule

May I add, that if the days I was out due to family illness & death are counted then I will be under the amount of allowed days outside the UK within the last 10 years. However, one summer I was away for 104 days (which happened to be the summer when my grandmother died unfortunately) - but I'm ...

ILR 10 Year Absence Rule

Hi, I'm currently eligible to apply for a ILR via the 10 year route. However, I am quite over the allowed amount of days outside the UK over the last 10 years. Some of the days were for business reasons, which I've heard is often excused. Some other times I had to leave due to family illness ...

I thought it was - but thanks for confirming.

Also confirms I'm not going with that immigration lawyer moving forward then!

Which ILR Route Can I Take?

I currently am eligible for ILR through the 10 year long residency route, however I might have too many absences to qualify at the moment. But I will have been on a Tier 2 (General) visa for 5 years at the end of 2017, making me eligible to apply for ILR via the 5 year working route if I wait ...
