@gokulati i must say you are very well informed person about these directives. Well in thier refusal they didn’t explain though just written MoC. And that refusal was more than a year ago. gokulati we have a son who is three years old, plus proof of traveling together n plus proof of living together ...

Another curiosity is this that previous refusals are going to be any obstacle on the border, i mean border guards will definitely know about previous refusal which was unfairly reasoned marraige of convenience. That refusal actually brought me here but i m afraid it is going to disturb my plans ...

Most definitely i m going to keep giving updates until the end but as i am going through internet for the mode of transportation and cannot find anything going to border. I am happy for you but it took really long time one year is too much. Anyway I hope you are getting ease in future because of this. Coming back to OP does someone know anything about applying in eu embassy on tourist visa or going to schengen land border?

Well be prepared in advance for lot of time and discussion with border gaurds if you decide to go to border without visa. As far as I know according to the directive if you appear without visa n you manage to prove your family ties you should be granted visa on the spot.

Solvit is really slow with their jumping in and help, while on tourist visa remaining one one and half month i can rely on Solvit, is there any eu home dept I could contact to get help?

Sorry if i have offended you n i m thankful for your helpful answers. I just wanted to lighten up a point that non eu family member’s status in the country from where they are applying doesn’t matter. I would say maybe being illegal would be a problem.

Thank you omi but why not? This directive doesn’t require to leave the eu state before visa expiry. I mean first three months aren’t unconditional?

I hope you will get visa but there are some cases on this forum who got visa after arriving on airport or seaport, didn’t read about land border. Cases like people appeared on calais n got visa from french or couple at warsaw airport got entry. Maybe someone else can also give references to success s ...
