Re: citizenship for our kid born in the UK before we got ILR.

A UK born child is entitled to register immediately after a parent is granted ILR. There are no other requirements.

Yes. Adults under 65 years old require both English language and Life in the UK for ILR.

If he fails KoLL, then they may extend for 3 years before their leave expires.

Re: PBS Dependant visa extension - Tier 2

Son’s entitlement to register should be unaffected. Unfortunately , the rush to get a quick decision may effectively deprive her of a possible opportunity to vary an outstanding application to an ILR application, when she becomes eligible for ILR. This prevents them from refunding application fees w...

Re: PBS Dependant visa extension - Tier 2

As suggested , I wouldn’t rush claiming a IHS refund until your wife gets ILR ( and when you are certain of current IHS exemption). Claiming beforehand may make both you and her stressed out, similar to her rushing to make this priority extension application. Moreover, do take the time to fully inve...

Re: PBS Dependant visa extension - Tier 2

1. SW 36.1. (b) grants 3 years leave. ILR is not automatic. ILR is a voluntary application and many don't apply. She may calmly apply for (or vary a pending extension application to) SET(O) , when eligible. 2. Claiming back IHS shouldn’t affect an ILR application. But it may be less stressful, if sh...

Agree with Amber.

If you Google:
self sponsorship skilled worker visa
You will find:
It’s not a category of the visa but a route or strategy which allows business owners and entrepreneurs to run their businesses in the UK.
Etc.

Unfortunately, over the years, they have made the Immigration rules and guidances too complex; even possibly corrupting the intended nature of these rules.

Forgot to ask. Hopefully, you don’t have a SOC code that may also prevent dependants from applying?

Re: ILR- Applying to extend PBS dependent visa

If you were previously, for example, a Skilled worker, immediately prior to ILR, then 1. Answer the dependant questions as if the lead holder is a Skilled worker. 2. Unlikely, as SW 36.1. (b) grants 3 years leave. 3. Put a date 3 years in the future . There may also be a possible (yet untested?) alt...

Re: Skilled Worker Dependent Application Queries

If their current category is a Skilled worker, then I think you should have answered “YES” to the question “main applicant already has their Skilled Worker permission”.

See also Given name.

I’m guessing answering “YES” to the family linking code is okay as you have provided a UAN.

Re: Child depdendant of Skilled Worker Given Visa According to other Parent s remaining Leave/time Duration

If the irrational SW 26.4A. prevents father from applying in the UK, then he should make an entry clearance application from his home country. 1. Father may include the children in his (in-UK) dependant application. Or they may also apply separately, in-line with father, before their leave expires. ...

Re: Checking ILR eligibility- compelling reason not to re-enter on time

If you have
Leave to Remain in the UK until 11 July 2025
then there’s probably no harm done by withdrawing. There’s plenty of time to calmly apply again before leave expires.

I think Continuous residence is unbroken and regarded if leave expires outside the UK and the holder returns within six months after departure with new includable (e.g. not as a visitor) leave.
