There is no problem registering your children as BC. For UK born children, one parent needs ILR. There is no need for them to be dependent on that parent (or even have a valid visa). FLR(M)?

My wife has got ILR 6 months ago. on 23/12/2011 i sent application to HM for me using SET(M) form. on 17/5/2012 i had receive the letter which stating all application was refused. cause my visa expires on the end of August. i cannot appeal.
