It doesn't work like that.

Caseworkers follow the immigration rules, no discretion as the rules state 3 years for an extension when the main visa holder has obtained ILR.

Note it is not compulsory to apply for ILR at exactly 5 years.

Option 3 is not possible for your daughter. She follows the same visa path as your wife. They either both change visa route or both extend their existing visa route.

The family visa route is not immune from policy and rules changes.

Your daughter qualifies for ilr when your wife does. If she is not UK born, there is no shortcut route for her

The quickest route to ILR for them is if they stay on their current visa route.

Your route to ILR is completely irrelevant. Solicitors talking absolute rubbish.

The rule is simple, you can apply for citizenship immediately if you are married to a British citizen AND you meet all the requirements.

She needs a new test. Skilled worker dependent visa does NOT (and never has) have an English requirement so her test would have been disregarded completely. You can only use an expired test if it was used in a previous application that was successful and where English was mandatory requirement. This ...

You simply apply for a new visa with a new CoS and the current approved one will be cancelled if a new visa is approved. You have to pay all the fees again with a new visa application.

You cannot withdraw a visa that is already approved.

Children do not have a 5 year residence requirement. They apply to settle when the parent does.

How long has the main skilled visa holder been in the UK?

Application date is ALWAYS the date you submit online and NOT the biometric date, which is only a formality and identity check.

1. Correct. She can only count dependent visa time for ILR based on 5 years residence.

2. 4th Nov is the start date, and then minus 28 days is the earliest she should apply.

Your children born abroad need ILR first and can apply for citizenship when your spouse does.

There is no shortcut route for them simply because you became British.
