spoke to my HR, he said that he has been doing this for many years now and it has never been rejected on that basis.

The company contract is 36.5 hrs so you have to proportionate the salary on that basis.

I will try to explain this to HR.

My HR suggested that as the soc specifies hourly rate , you have to take the
Hourly rate in consideration . Doesn't matter if it is 35 hr or 40 hrs per week.
