If you are claiming benefits you are entitled to, that will not affect your spouse’s immigration application. Their claim is closed when they failed their HRT, they will need their own account to link with you so will need to make a new claim.

You now need to make a new claim for UC, link with your husband and you’ll have another habitual residence test as you now have ILR, you should pass. Provide UC with an S share code.

If you are claiming benefits you are entitled to, that will not affect your spouse’s immigration application. You cannot use your UC towards the financial requirement for SET(M) unless you are only required to show adequate maintenance and accommodation eg because you get PIP.

If a the child is subject to immigration control (ie - no recourse to public funds restriction) you claiming benefits due to their presence may breach their immigration restrictions. If they request it, you need to send it. You can send a special delivery package and ask them to send it back in that.

Yes, your spouse meeds to make a UC claim even if subject to immigration control. Then you link the two claims. Your spouse’s claim will fail as will fail the habitual residence test and the claim will become a single claim. Any income or capital your spouse has will still be considered.

Childcare support (excluding UC childcare costs) is not public funds. So should not be an issue. I assume you were settled after your child was born.

If you apply now and backdate 3 months that’s March 2025. If you were granted ILR in Feb 2025. I don’t see what the issue is?

I would think not, deprivation has to have an element of intent - that is to dispose of capital in order to secure or continue entitlement to benefit. You can challenge the decision should they decide deprivation.
