Skilled worker Dependent visa extension when main applicant got ILR

Post by SSAHU » Tue Nov 14, 2023 2:23 pm

Hi All,

From sponsorship, I got UK visa for 5 years from 3rd Dec 2018 to 30th Dec 2023.
I had applied ILR on 6th November and got the decision on 8th Nov 2023.

My partner and son has Tier2 dependent visa up to 30th Dec 2023 same as my OLD BRP. They entered UK on 29th July 2019. So by 30th Dec 2023 they will completed 4 years 5 months. So, need to extend their dependent visa.

I have filled the application form and when moving to IHS section, I am facing some date related issues as below:

1. It is asking “work start date and work end date" of main applicant.
As per my CoS, my start date is 17-Dec-2018 and end date 16- Dec-2018. Do I have to use this ? or
As I had already moved to ILR, which date will be used for start and end date ?

2. As per old BRP, visa expiry date was 30th Dec 2023 (old BRP returned to Home office) and new BRP (ILR) shows valid upto 30-Dec-2024.
Which date should be entered for the "visa expiry date of main applicant"?

Could any one help me for the above queries.

The dependant visa is granted for 3 years if you have ILR. This is fixed and you can not request a shorter period. You must pay 3 years of IHS fees then.

The immigration health surcharge online system is not smart enough to calculate this automatically. ILR has no expiry date. You should enter a date that is 3 years in the future to get a correct IHS calculation. Otherwise, the system will charge you less and the caseworker has to request you to pay the remaining fees, delaying the application.

Many thanks Zimba for your quick reply.

So, here my start date would be ILR issue date (08-Nov-2023) and end date can be 07-Nov 2026 which is 3 years.

For 2nd point , can I use some later date from 07-Nov-2026 as my visa expire date ?

Also, as my CoS was for 5 years, do I have to pay dependent visa extension fee for 5 years ?

Again, there is no ILR expiry date. Those dates are strictly used to calculate the IHS fees. So follow as advised

No relevance at all. A dependent visa is issued for 3 years only. Neither your old status as a skilled worker is relevant nor your CoS

Thanks Zimba,

One section says, "enter visa expire date ". What date should I enter here, it is not allowing me to proceed further without this.

For 2nd point, same thing --I have to enter my previous Cos details . either less then 3 years or more then 3 years.

I know Cos is not relevant now for dependent visa, but if I mention previous CoS is for 5 more than 5 years, it will ask me to pay 5 years visa fees.

Can I mention less then 3 years in that section even if my CoS is for 5 years ?

Again, you should enter the dates such that the IHS calculation is correct !

Point 1..
I am clear on IHS calculation for 3 years.

doubt in point 2, as ILR has no expiry, what date to be used in “visa expiry date of main applicant"? As this date also mandatory to proceed further for IHS pyment ?

Can we use BRP valid upto date and submit one cover letter and explain.

Hi SSAHU,
Did you manage to get a successful extension application for your family? As I have a similar situation.
Thanks
