Skilled Worker Visa Eligibilty

Post by Pratik94 » Sun Feb 25, 2024 7:15 pm

Hi, I am currently working on a 2 year Graduate Visa (Post Work Visa) since September 2022 after completing my masters and my visa will get expired in December 2024. Below is my current scenario:
- The company I work with is in the sponcered list of companies and they have agreed to sponcer me a skilled worker visa later in the year (mainly after June 2024) before the expiery of my current visa.
- My current income is above the new Skilled Worker Visa requirements (i.e. 38,500 Pounds per annum).
- I currenty work in the field of Environment as a consultant and I believe that when my company will apply for SKilled worker visa later this june, they will apply via the SOC 2020 code 2152 - Environmental Professionals.

As now the Shortage Occupation List (SOL) will be replaced by the Immgration Salary List (ISL) later in 2023 as part of new regulations, will 2152 SOC code remain in the new ISL list? My concern is that based on the latest Rapid review of the Immigration Salary List text (published on 23rd February 2024 - https://www.gov.uk/government/publicati ... accessible), there was no mention of 2152 SOC code and its repesctive changes.

So could someone help me to understand if my company be eligible to sponcer me a skilled visa post the implementation of these new regulations? Thank you for this support on answering my question.

There are essentially two lists with eligibility for SWV SOC’s. The standard list and the SOL /ISL to be.
It would appear your SOC 2142 is on the standard list and will continue on that list.
The new salary threshold change will apply but as you are earning above that it will be ok - as long as the rate for the job is not higher.

Thank you for the reply Frontier Mole. Also wanted to know will there be any change in the salary rate for the job as part of standard list based on the new regulations? If yes, any idea when the government will publish those changes or will it be public? Thank you.

There is an indication that the rate for the job is going to increase across the board but until there is an official announcement from the Home Office no one will be able to state what that will look like.
Given the current rate for the job in your SOC - I doubt you are going to struggle meeting the increase. It is likely that the rate for the job is going to be below the £38,500 threshold. So the minimum threshold would be the minimum salary rather than the rate for the job.
