spouse visa for asylum seeker (partner)

Post by Taligh » Fri Jun 14, 2024 7:18 pm

Hi,
I'm an Italian citizen and I live in the UK where I have my ILR (settled Status).

My partner is an asylum seeker in Italy and we are trying to understand if there are possibilities to join me here with a spouse visa.
As an asylum seeker can he apply for a spouse visa?
If he gets asylum protection can he apply for a spouse visa?

I read all the spouse grounds for refusal and I can't see anything that says no but is a lot!

We aren't married yet, but we will probably do it in one year so we have more evidence of a genuine and effective relationship.

Thanks

Applying for a spouse visa might not fly. Before I go on, you need to know that nothing stops him from applying for a spouse visa. Getting a successful outcome is the issue.
If he's claiming asylum in Italy, then he probably might not have a passport.
You're also not married.
You're not living together akin to marriage.
You've got better chances in the EU.
No sin in failing, you just have to try and try again!
