Could someone suggest me an option for the below question?
I have Tier 2(General) visa valid from 17/07/14 until 28/07/19 and my entry date to UK was
26/07/2014. I will be completing my 5 years’ time scale by July 26,2019. So, I am eligible to apply for
ILR. My wife and 2 children have Tier 2 dependent visas which are valid from 23/03/15 until
28/07/19 and their entry to UK was on 29/03/2015. They will be eligible for ILR by 22/03/2020.
All our visas are expiring on 28/07/19. I am still working with the same employer and will continue
with this employer. I am considering the options now and would be grateful for your advice.
My Questions are :
1. I can apply for ILR as I am eligible. My family needs another 8 months visa to qualify for ILR.
Rule says that they can extend their PBS dependent visa for fixed 3 years. This will be an
expensive option as we will have to pay IHS for three of them which comes to £3600 for 3
years. So I am considering extending my tier 2 visa(rather than applying for ILR) for 1 more
year. This will allow my family members to extend their PBS dependent visa for just 1 year
and so we pay less IHS. We will all be able to apply for ILR next year together if we choose
this option. My employer may even bear the full or partial cost of the visa but not for ILR
option. Do you think the home office will let me extend my tier 2 visa for 1 more year while I
am eligible for ILR?
2. If I were to apply for ILR now and extend my family visa for another 3 years, the total PBS
visa for my family will go up to 7 years. But the TIER 2 total amount of time leave should not
exceed 6years.
