Transfer of Employer for a skilled worker VISA holder

Post by mukhs9 » Mon Feb 20, 2023 8:55 am

Hi, I have been in the UK since 2010 on a Tier 2 ICT VISA. Recently in March 2021 I changed my employer who sponsored a Skilled worker VISA for me for 5 years and I had to process the Dependent VISA for my wife and daughter accordingly for 5 years.

Now if I wish to change my job and the new job is under skilled worker category , I wanted to know what would be the process to do that i.e do I have to re do the VISA process again for myself and my dependents and spend the entire amount (VISA fees + NHS health surcharge) again for all of us, or is there any shorter way , where in if I get the CoS from my new employer , I just need to reach out to home office regarding my change of employment and the rest of the details and VISA status will remain the same.

Please do let me know if anybody has any information regarding this process.

If you change employer, you have to apply for a new visa with a new CoS and pay the fees again. Your current visa is not transferable to another employer.

Many Thanks for your response. And what about my dependents, do they have to apply again along with me. And what about the NHS health surcharge, will I need to pay it all again. Will the amount paid earlier be refunded.

My understanding is they do not have to apply again. Just you.

Yes you have to pay IHS again. You might be a refund of the overlap.

Dear Moderator,

I have another question regarding the same topic but for my dependents.

While I wait for my 10 years to complete on March 2024, I have my wife and my 6 year old daughter along with me in the UK , who are on my dependent VISA. My daughter was born in India on 14th December 2016 and came down to the UK on 14th September 2017. Since then she has been in the UK. Now I was going through this document "Dependent family members in work routes" version 6.0 and from this what I understand is , as my wife and my child who are both my dependents, my daughter can apply for ILR along with me when I am eligible for my ILR via the 10 years route on March 2024. Is my understanding correct. Or she has to wait till both my wife and myself get ILR and then she automatically gets eligible for ILR. My wife is not eligible for ILR on March 2024 as she has a gap of more than 6 months during her stay in the UK since she joined me on May 2014.

If you can clarify this doubt for me that would be great. Thank You.

Your daughter can apply for ILR when your wife does.

Long residence ilr doesn't permit dependents to apply with you.
