Certificate of Sponsorship: Gross Salary and allowance detail wrong

Post by edw » Tue Dec 08, 2020 8:19 pm

Hi all,

I'm in the process of extending my Tier 2 visa. I went to UKVCAS yesterday to enrol my biometrics and scanned my passport.

However, today when I have a look again at my certificate of sponsorship, I realise something is not right:

Total weekly hours of work: 37.00
Job type: 2425 Actuaries, economists and statisticians
Gross salary in pound sterling including any allowances and guaranteed
bonuses: 29732.00
For each: Year
Gross allowances and guaranteed bonuses included in the above figure
in pound sterling: 6000.00

I think my company's HR put the gross salary wrong - it should be £29732+£6000=£35732 (based on a 37 hour work week), so that it would meet the threshold of £37000 for my SOC code (based on a 39 hour work week)

What can I do now? My current leave to remain expired on 3 Dec 2020.

Thank you in advance!

Add a cover letter regarding the same and try to upload it to ukvcas site quickly. I think you have 24 or 48 hrs after Biometrics appointment to upload further documents.

Get your employer to add a note to CoS via SMS system about the mistake. Hopefully, this should help avoid a rejection.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Thanks for the advice.
I just tried to upload a cover letter with my payslip but it doesn't show as 'submitted'. I callsed UKVCAS and they told me no additional documents would be submitted to UKVI after the appointment is made.

I also called UKVI and they said they would only contact me for further evidence if they feel there is a need once they review my case, and in the meantime I wouldn't have any contact email for submitting further evidence.

Just told my HR about this to see if a note could be added to the CoS via SMS system.

I wonder what I should do as next steps if I get the decision letter that my visa extension is rejected? It would be after my current leave has expired...Would I be treated as an overstayer? Could I continue working at the company if I submit a new application again? Would it affect my ILR application later in 2 years?

There are a few email IDs & postal address mentioned on this forum so try to send email & also post a letter to relevant team mentioning your UAN reference number.

As long as it reaches before they make a decision or if the caseworker figures out the mistake and emails you (unlikely as payslip/bank statement may not distinguish breakdown), you may be ok.
