Defined CoS Application Process and Expedited Procedures

Post by surefire » Fri Feb 16, 2024 9:03 pm

Hello everyone,

I'm reaching out to seek guidance on the process of applying for a Defined Certificate of Sponsorship (CoS) for a prospective employee. Our situation is a bit unique, and I have several questions that I hope someone here can help clarify:

Candidate Details for Defined CoS: Do we need to have the candidate's details ready to request a Defined CoS? Given the circumstances, we're keen on understanding the requirements before we proceed.

Processing Time: How long does it typically take to receive a Defined CoS once applied? Any insights based on recent experiences would be greatly appreciated.

Level 1 User Delays: We are currently experiencing delays in the change/addition of a Level 1 user on the system. The existing Level 1 user is related to the candidate for whom we need to assign the Defined CoS. Can we still apply for a Defined CoS while we wait for the Level 1 user details to be updated? If so, what steps should we take to ensure compliance and efficiency during this waiting period?

Salary Thresholds and Old Rules: We aim for the new employee to be sponsored under the old salary threshold rules, specifically under the £26k salary cap. Is there any way to expedite the Defined CoS process to meet this criterion, especially considering the ongoing administrative updates? Any tips or procedures to navigate this would be immensely helpful.

Our primary goal is to ensure a smooth transition for our new employee while adhering to the legal and procedural requirements. If anyone has gone through a similar process or has advice on expediting the Defined CoS application under these specific conditions, your input would be invaluable.

Thank you in advance for your help and guidance.

Until you get another level 1 user on the system you will not be able to assign a COS even if you do get a DCOS.
You will be expected to name the individual as why would you want a DCOS if you “don’t” know who the individual is?
You also have to state on the sponsor notes that the individual is related and in what way when the COS is assigned.
Getting a DCOS is not a one size fits all process, given the circumstances the Home Office may ask for more information and then deny the DCOS.
