I am currently in the UK on a Skilled Worker Visa (software programmer). Recently, I received a job offer from another company and my Skilled worker visa is transferred and I have received new BRP. Currently, I am serving notice period in my present organisation.
Unfortunately, my present organisation has a visa fee clawback policy and hence I need to return the visa fees.
The current visa was valid until 2024 and hence there should be a partial refund of Immigration Skills charge and Immigration health surcharge.
My problem is, the company solicitors have accepted that Immigration Skills charge will be partially refunded. However, also claiming that Immigration health surcharge will not be refunded and provided me the following link:

This link mentions that the IHS will be refunded but under circumstances like application withdrawal.
I called up home office twice and they suggested that the IHS will be refunded in my case.
How do I now convince my employer about this. Is there a link that I can share which mentions that transferring skilled worker visa IHS is refunded. I could not find any.
