Hello everyone,
I have joined the MSc civil engineering with an industrial placement at the University of East London and the course completion date is on 20/01/2024. completed all modules and left with an internship along with a fee of 3500 pounds left to pay. I dropped an application for tier 2 switching from a student visa on 10/07/2023. I received an email from the university on 25/07/2023 that they are terminating and withdrawing my student visa and they asked to submit evidence in case of switching to an alternate visa. considering the email, I sent an email on 27/07/2023 stating my process of switching to tier 2. I got a rejection mail on 04/09/2023 for the tier 2 application which I made on 10/07/2023.
There are a lot of changes in immigration rules and all those announcements happened after a week from my application date. But still, they mentioned the new rules as their reason for not considering them in the rejection mail. I request you all to help me out with this. Looking forward to better suggestions for further decisions. I have mentioned their reply in the mail below:
" You have attempted to make an application for permission to stay in the United Kingdom (UK).
Your application has been rejected as invalid and will not be considered for the reason set out below.
You have applied for a Skilled worker visa; you must meet the validity requirements stated in the Immigration Rules Appendix Skilled Worker. We have noted that your current course expected end date is 20 January 2024
Immigration Rules Appendix Skilled Worker states:
SW 1.5A. An applicant who is applying for permission to stay and has, or last had, permission as a student, must fulfill one of the Conditions A, B, or C below on the date of application:
(a) Condition A: the applicant must have completed the course of study for which the Confirmation of Acceptance for Studies was assigned (or a course to which ST 27.3 of Appendix Student applies); or
(b) Condition B:
(i) the applicant must be studying a full-time course of study at degree level or above with a higher education provider which has a track record of compliance; and
(ii) the Certificate of Sponsorship in SW 1.2(d) must have a start date no earlier than the course completion date; or
(c) Condition C:
(i) the applicant must be studying a full-time course of study leading to the award of a PhD with a higher education provider which has a track record of compliance; and
(ii) the Certificate of Sponsorship in SW 1.2(d) must have a start date no earlier than 24 months after the start date of that course.
SW 1.6. An application which does not meet the validity requirements for a Skilled Worker is invalid and may be rejected and not considered."
