Tier 2 Codes of practice for sponsored workers

Hi,

I was trying to find suitable SOC job code for my job and found that there are two sets of document for Occupation codes of practice for Tier 2. One is for Graduate level and other is for NVQ level 3. What is the difference anyways??
I compared these two documents and couldn't make out much difference, although there are some subtle differences.
Please could somebody help me understand why two different Tier 2 Codes of Practice are available on the UKBA website and how to use them?

From 6 April 2011, applicants under Tier 2 (General) or Tier 2 (Intra company transfer) must have an offer of a job at or above graduate level if they are:
- applying from abroad; or
- applying to switch into Tier 2 (General) from a different immigration route.

Applicants who are currently working in the UK (either for you or for a different employer) under Tier 2 (General), Tier 2 (Intra company transfer) or a work permit must have an offer of a job at or above S/NVQ3 level.

Some Certificates of Sponsorship can only be issued to degree (graduate) level jobs. And some can be issued to degree-level jobs without a resident labour market search.

I agree it's appallingly complex though. The UKBA nowehere clearly defines, for instance, what "degree level" means. I was looking for this myself earlier today and it's not specified.

Also, I found today tucked away in some guidelines on Tier 2 (paragraph 293) that someone extending their stay on Tier 2 ICT is fine to do so, but if the person happens to be on business outside the UK when their renewal date is due, they will not get a new entry visa for the further 2 years they would otherwise be entitled to. These guidelines are confusing, to say the least.

According to the immigration rules, an applicant looking to apply for an extension of their current leave (further leave to remain in same category) should make an in-country application. Only in-country applications would be considered for extension (further leave to remain) not out-of-country applications.

Out-of-country applications = fresh application for permission to enter the UK.

Thanks for your replies. I need your help. I am currently on tier 2 ICT and after a long search I’ve found a company that is willing to sponsor me for tier 2 general but on a condition that I’ll do all the background work. My application will be subjected to Restricted COS category as I’ll have to leave the UK and apply from my home country. The job profile is of a business analyst and I am searching for a suitable job code. I’ve found 2 job codes 2423 and 3539 that are close to the role. But I am confused as which one to use. It is because according to new rules & guidelines for tier 2 general when applying from outside, must be applying for a graduate level job.
