HI Manci,

Thanks for all the good replies , I earlier discussed my situation in another forum regarding switching..

I have a new employer from reputed company and they sent me the cos # yesterday . He said the system now instantly provides a cos number and said that's all that is required post RLMT . Bit confused as my understanding was it takes sometime after the RLMT is done and then they request and is appears in their SMS system...

I am planning to apply for visa in a few days..

Just the following questions..

1.) Can I apply online ? then print and submit in person etc?

2.) Do I need to submit like

- Offer Letter
- COS Letters ( confused as they suggested COS Number is enough)
- Maintenance Letters ( there is option to say previously proved maintenance), should i still request and submit them for myself and defendants
- English Language (there is option that says previously proved skills under tier 2),should i still submit them ?
- Other Docs like , Residence Proof, Marriage Certificate/Birth Certificate (Defendants)
- Photographs etc..

3.) No where during the application process it says change of employment .. IS this something that's added in the COS ?

Can you pls. shed some details.. I somehow feel it will be good if i wait till they give me a copy of COS and Iam so confused with docs...

Is there anything else I need to be worried about ??

I, like you, am also in the process of changing employer. In order to change employer, we just need a CoS number from the new sponsor. The evidence of having done the RLMT is provided by the sponsor to the UKBA while generating the CoS. We don't have to do anything regarding the RLMT or change of employment (applying with a CoS from a new sponsor is proof that you are changing employment).
Once the sponsor gets the unrestricted CoS from UKBA or if they already have a spare one, they assign it to the new employee and usually e-mail it along with all the details to the applicant so that you can confirm the company address, CoS number, salary, etc. before filling your application form. Using the CoS, we basically have to make a new Tier 2 (General) visa application and submit our passport, BRP, 2 photos, maintenance proof (3 month's stamped bank statements) and English language proof. Once the new visa is granted, UKBA sends the applicant an approval letter and their new BRP which is tied to the new CoS that states the new employer's details.

P.S: Congrats on your company issuing you a CoS instantly. As far as I know, each sponsor orders a few CoS at the beginning of the year. So, if a sponsor has a CoS allocation left in their visa (SMS) account, they can instantly issue it to a new employee. In my case, unfortunately, the employer had no spare CoS left. So, they put in a CoS allocation request over 2 weeks ago to the UKBA to get a CoS for me. :( Hopefully they'll get it soon & assign it to me so that I can use it to apply like you. Good luck.

Sound really good, then if they can assign it so quick .

I have been checking other places as well and some seem to submit Police Certification.. I don't have any such remarks on my visa nor am I changing diff category.. So Not sure if we need to attached Police Certification...

Also about maintenance .. I have enough now, but don't think I had the same amount in my account for a continuous period of 90 days, as I had to use my savings .. I have only 2 months payslips so far...So my option is to wait for my current employer to confirm if they certified maintenance.. If not , can a cover letter from the employer help ?

Yes it's good they were able to do it fast.. but I now wish they consulted me ..Hope for the best...And Congrats for you as well mate ..2 weeks ago would have been before the 5th and you should get it by the 11th or 12th in their System..

Let know if you have any information and so will I ....

the Tier 2 A-rated sponsor providing a written undertaking that, should it become necessary, it
will maintain and accommodate the family member for a month. The undertaking may be limited
provided the limit is at least £630 per family member.

If you apply at the same time as the main applicant, you are only required to provide evidence
that you meet the maintenance requirement when the Tier 2 Migrant is also required to meet the
maintenance requirement. If you apply separately from the main applicant you will always need
to have the necessary funds to meet the maintenance requirement or have a written undertaking
from an A-rated Sponsor.

Does this mean

Whilst in UK and doing a in country new employer switch, when Iam unable to produce bank statements

1.) My sponsor has to certify in COS that he will support / does it not matter.
2.) For dependant's is it just a letter from sponsor supporting maintenance enough

They can provide evidence of the required funds
A-rated Sponsor certified maintenance for this dependant on my certificate of sponsorship

When did your sponsor apply for the unrestricted CoS ? How long did it take them to get one (2 weeks or 3) ? Mine applied on 23rd Sept. so I was hoping to get it this week but it is still "pending" as of today.

Yes, as far as I know this is exactly what is to be done if you are not applying using 3 months' bank statements. The sponsor can certify maintenance for you in the CoS and provide a letter for any dependants and that will suffice.

The online application has these options and I am confused what to chose

Yes I can get letter from them, my sponsor is not sure if the HR selected the option for maintenance . They will check and let know ..But they will be able to give in writing for dependants which should cover that..

But for main applicant is there a need to show proof if they said no in the check box ???

But that url is for restricted CoS for applications made outside UK (& it has an annual limit on it) whereas since I am a Tier 2 visa holder currently in UK making an in-country application to change employer, I'll be using an unrestricted CoS, won't I ?

As far as I know, you have to either show maintenance proof yourself via the stamped 3 months' bank statements [or building society passbook] or the sponsor checks the checkbox for certifying maintenance while assigning the CoS to you.

as per this below I do have an option to chose in my online form options 2

Pg 79 of T2 Guidance says... 3 options

90 day period (finishing on the date of the closing balance), ending no more than 31
days before the date of their application. You must not include an overdraft facility as
available funds.

2.) Currently have entry clearance, leave to enter, or leave to remain as a:
o Tier 2 migrant
o work permit holder
o Jewish agency employee
o member of the operational ground staff of an overseas-owned airline
o minister of religion, missionary or member of a religious order, or
o representative of an overseas newspaper, news agency or broadcasting
organisation. Or

3.) Have an A-rated (premium), A-rated small or medium-sized enterprise or A-rated sponsor who certifies on the certificate of sponsorship (CoS) that they will
maintain and accommodate them up to the end of their first month of employment in
the UK if required

Hi,
I got my CoS today, almost 3 weeks after my new employer had applied for it. :)

Regarding Section O (maintenance) in the T2 (Gen) form, even I am confused as to whether we have to show 90 days' stamped bank statements or just selecting, I am a Tier 2 migrant would be enough.

@Manci: please help ! do we need to show any maintenance proof or not ?

Update:
My new sponsor has assigned me a CoS and they have also certified maintenance on it. I have a few queries about this:
1) I believe I do not need to submit any proof of funds now or do I ?

2) I will be applying early next week for the visa using the premium service as I have to relocate to another city next Friday so as to start my new job from 27th Oct. (Mon.) onwards. If I get my visa approval early next week but do not receive the new BRP in the post by 27th, can I still start my new job or not ? Should I wait to have the BRP in hand before relocating and starting the new job ?

3) And, can I give a new address to the UKBA to deliver the BRP to when I am at the premium visa service centre instead of my old (present) address ?

I got my COS today with Maintenance certified...

Trouble it has a wrong NI number in there :-( ....

Could you kindly confirm how to proceed further pls ?? What to put in the form ??? and should a letter from employer be attached ??

on Page 10 - line 58 says

58.  For example, where the Tier 2 Migrant is submitting an application because they are changing
employment within Tier 2, neither the Tier 2 Migrant nor any family member is required to submit
evidence that they meet the maintenance requirement.

So I am thinking we don't need to submit any other proofs... but

I think if the sponsor has certified maintenance on the CoS, we do not need to provide any evidence of our own for this.
But, please confirm and let me know as well.
