can employer cancel my T2 visa?

Post by KateS » Thu Apr 10, 2014 7:01 pm

Hi all,
I've been living in the UK for 4 years. First on T4, T1 (PSW) and in Nov'12 my employer offered me a sponsorship, so I switched to T2.

Now i'm pregnant and was off sick for 4 weeks (all docs are provided to employer). They already hired someone to replace me. Now i have been told that my visa will be canceled. I have few questions:

1. Can employer cancel my visa without terminating my employment contract? So in this case i have no right work and my contract will be terminated automatically if i don't provide documents that i'm eligible to work
2. or they have to dismiss me first and only after they can inform HO that contact was terminated and my visa needs to be canceled.

Thanks,
Kate

There are two separate issues here.

Under immigration law the company can dismiss you and withdraw their sponsorship any time. If this happens your visa will be curtailed to 60 days from the time the HO make the curtailment decision (not from the date your sponsorship has been withdrawn).

Under employment legislation your dismissal may be unfair and you may take legal action. See:
https://www.gov.uk/dismissal/unfair-and ... -dismissal
Seek employment law advice, e.g. from a Citizens Advice Bureau
