workpermit to HSMP

workpermit to HSMP

Hello,

I was on work permit from Oct ’02 to Oct ’05. During that 3 years time and I was jobless for 4 months. But before my visa was expired (Oct’5), I was able to find a job but was told that I had to apply for a fresh work permit and go back to my home country for a new EC. Well I did that all and came back to the UK on a new work permit & EC for 5 years. The poor thing is my clock had been reset as you can understand.

My wife came into the UK last year as a HSMP holder and she was able to get an extension for 4 years in last month.


We have been married for 1 year now.

I wonder is there any chance can I change my visa category as a dependent?
Or can I claim any point as a dependent ?

Dear ejb.. One point is not clear to me...

You said you were jobless for 4 months.. and that is why you went back to your country and applied for fresh EC for 2nd workpermit

But when you apply for new workpermit within UK as in-country applicant, no where you need to give any new document, not even the reference letter from current employer.. Just the old workpermit reference number will do then how did they identified that you were jobless for 4 months?? This is my biggest doubt


Did you told that by yourself??

Because I think this jobless issue is not a matter at all, if your workpermit is still valid & if you are financially well to support yourself

You could have avoided the restarting of clock

Your first workpermit is valid till Oct 05...

and You got job by Oct 05

What you should have done is, You should have applied for workpermit in-country on same oct-05

also should have applied for FLR IED on same Oct 05 based on that workpermit.. FLR IED will be automatically approved when That work permit is approved. This is how many people will do with hsmp also

But your jobless 4 months must be hided and off-course that could have been done easily

Thanks hari15 for your suggestions.

What happened was , i started off my first job in 2002 on my first work permit for 3 years. But i lost my job in 2004 and was able to land in another job within 30 days.
But when my second employer had applied for change of work permit, the home office refused on the grounds: Lack of advert & salary . so i could not continue that job and also the company had informed the home office that they could not employ me sine it was refused.

But i got a letter from the home office i can stay in the country unctil oct'05 even though it was refused.

Well, 2 months before my visa was expired, i got an offer for a job but i had to leave the country for my personal reason and they had applied as an out-country applicant and got a new WP for another 5 years.


Hope this makes clear now.



now i have been on this new workpermit + with new EC for 12 months.

but my wife was able to secure her HSMP extension for 4 years.
now , would it be a good idea to claim point under hsmp as her dependent ? or would the home office consider those 3 years (i don’t think they would).
