Student Visitor Visa (Japanese National)

Post by yingyangryder » Sat Jun 30, 2012 9:34 pm

Hello, this is my first post so do forgive me if it's in the incorrect section.
I have quite a long winded question.

My girlfriend is a Japanese national and she is coming to England next month to study a 1 month long English course in Birmingham. Upon completion of the course (end of August) she will then stay with me for 4 weeks as obviously she wants to see me and to do touristy things before she returns to Japan in the beginning of October, however she would like to visit Paris as a short trip while she is here as England - Paris is a lot cheaper than Tokyo - Paris.

QUESTION 1: Would she be able to leave the UK with me for a few days to visit Paris after her course has finished and then return on a tourist visa until she returns home in October? She has got a return ticket for Japan already.

Then to make things more complex, after she has returned home to Japan. She will then return to the UK at the end of October to study again, but this time she will enrol on a 6 month course in Liverpool (again on a student visitor visa) and return to Japan at the end of her course.

QUESTION 2: Is she actually able to get two student visitor visas within a short space of time? I have checked the UKBA website and I cannot see anything like YOU CANNOT HAVE MORE THAN ONE STUDENT VISITOR VISA PER CALENDAR YEAR.

Thank you for any assistance :)

1. Yes
2. All visit categories, when aggregated, can't exceed six months in a given year. So, you have to work out if she is likely to exceed that limit which, in turn, indicates if she is likely to be refused.

Thank you for your response.
She messaged me again today and told me that there is a possibility she will study for 7 months when she comes to Liverpool.
In this case, I imagine she could get a Student Visitor Visa in July and then a Tier 4 when she returns.

I'm not sure I quite understand what you mean by aggregated (sorry). I am probably wrong but I believe it sort of means like a total. So she would be here in the UK for about 9 months total, she would leave twice once to go to Paris and again to return home for a short time.

Again, I thank you for your assistance

Aggregate means to combine to form a total. If she enters the UK in a particular month, she is permitted to spend six months in the 12 month cycle that begins on the date she enters. It could be June to May or January to December, whatever. You have to work out if her intended itinerary will be for more than six months during any 12 month period. I can't help you do this as only you know her plans. However, this is the case only if all of that time is as a visitor. These limits don't apply to someone who visits and then returns in another category.
