Maintenance Fund for 90 days - Please help

Maintenance Fund for 90 days - Please help

My current Tier 1 (General) visa will expire on 26th May 2013 and I have to apply on 24th May as it is friday. I have all the required documents but i have made one mistake unintentionally. I forgot to keep 900 for maintenance funds for 90 days. I got remember on 7th march 2013 and put money on saving accounts on the same day. From 7th march to 24th may 2013, it becomes 78 days. I am short of 12 days. to claim 10 points. Can anyone please guide me what to do in this case?
Please provide expert opinion as it is related to my future. Also keep in mind this is my Tier 1 general extension for 3 years.

Where did you transfer the money from? If it was available to you for 12 days before and you can prove that then use that? Other than that, there's not much flexibility in the rules...

You could technically make an out of time application within 28 days of expiry of your current leave, thereby covering the 12 days shortfall in question.

No, as long as you apply within the 28 days deadline, you don't need to give any reason at all. Your application would be refused if you apply after this deadline though unless you have a 'valid' reason. The law regarding this came into effect last year and applies to all Tier 1 General applications made on or after 1 October 2012.

As you would be applying after your current leave has expired, you might not get a right of appeal if your application is refused due to any reason.

3C/3D rules basically means that if you make an in-time application, your current Tier 1 leave is automatically extended while your application is being decided or an appeal is pending. This might be a concern for you if you are employed as you wouldn't have valid Tier 1 leave/working rights while waiting for your application being decided.

So, I would advise you to make sure that your application and documents are in order and watertight as this might very well be your last chance. I would say get it checked over by a solicitor just to be on the safe side. Also, if you can, go for an in-person PEO application rather than a postal one as you would get a decision on the same day and thereby minimise the effect of the loss of the 3C/3D rights.
