HSMP rejected

Post by richie_rohan » Sun Sep 30, 2007 12:47 pm

Hi All,
I filed for my HSMP in August and it got rejected. Please find below the letter from HO stating the rejection.

The points break-up is as follows:
Sr Description Points claimed Points awarded
no
1 Age 20 20
2 Qualification 30 30
3 Previous earning 20 0
4 UK Experience 05 0

5 English Language req Qualified Qualified

Previous earnings:
Points were claimed for a period of Aug 06 till Jul 07.
Documents submitted: Form 16, P60 (both for year of 06-07), bank statements and wage slips for Apr, May, June, July 2007 for the period not under the tax evidence.

Following is the letter from HO:
You stated an income of 24,567 pounds earning in India and the UK.

The evidence you have supplied shows that you earned 8,372 pounds which is below the min threshold of Band A.

This amount was demonstrated by your wage slips as corroborated by your bank statements.

The figure shows your wage slips which were covered by the bank statements could not be taken into account as the tax evidence provided was not suitable.

The form 16 is not accepted evidence as it derives from the employer not the relevant tax authority.

The P60 provided was not an original document and had not been endorsed by the relevant tax authority.

In line with the published guidance, 0 points have been awarded.

My Questions are:
1) Is From 16 an invalid document? Then what is the valid document since SARAL is not more valid, will ITR be considered a valid document?

2) I have received my P60 as a soft copy from my employer so I took a signature and stamp from my employer and submited the same.

Please help me in this repective.

Thanks in advance.

Regards,
Rohan

Is it possible that you are ultimately asking the wrong questions? Quite apart from the fact that there were no other complete sets of evidence, it seems to me that the validity of the tax returns (such as they were) was irrelevant to your application, as they covered periods different from the earnings period claimed. From what I can tell, your application should have included:

- 12 months of wageslips from Aug06-July07
- 12 months of bank statements from Aug06-July07 (on the basis of exceptional consideration)
- the most recent tax returns, along with a notation for exceptional consideration that they were not to be used as the basis for corroboration because their coverage period did not correspond to the claimed earnings period.

Ultimately, your application failed because the evidence you provided could never be evaluated to corroborate earnings over the period claimed, since the tax returns covered the wrong period, and the bank statements and wageslips did not cover the whole of the claimed period.
