Staying outside UK for more than 3 months

Post by arvindkannu » Sat Dec 08, 2007 9:50 am

Guys someone here knows whether staying outside country for more than 3 months will affect me in getting back into the country or extending my HSMP. I got HSMP 2 months before and Iam working in London now.
Iam goin back to India for an operation.

Thanks in Advance....

Hi

Well I think the maximum timing out of country for HSMP is six months. You have no affects on your visa if you are out for more than six months but you would have problems in extention and ILR.

T_mahmood is right. So long as you can meet the earnings criteria despite not working, you could get your extension.

There would be implications for ILR because you are not allowed absences longer than 90 days at a time or total absences of 6 months. But I think if you get documentation from your doctor/hospital on the operation and hospital dates, you could apply for some type of exception if you do end up staying long enough for ILR.
