EC - from location different from my HSMP filing location

EC - from location different from my HSMP filing location

Hello there everyone – I need expert opinion (about EC for my wife) from senior members. Can someone pease look into this

I am Canadian National working in US. I got my HSMP approval and now I am planning to apply for EC in US (New York). My wife will apply for EC in three months time after I go to UK and things have settled down. I know it’s been advised on this forum to file for EC together with spouse but it is not possible in my situation.

In my current situation, my wife has US visa as my dependent. She cannot work (or go to school) in US, so she has predominantly been staying in Canada. I visit her in Canada all the time and she comes down to US occasionally.

My question is:

When she applies for EC in three months time, will she be able to apply from Canada?
I have seen forums here - advising that Entry Clearance can be applied only from the place where HSMP was issued.
In her case firstly she is a dependent. Also, she would not be able to apply from US, because I would not be working here anymore and thus she would be out of status to come to US.

Friends,

I have filled my HSMP and waiting for decision from India. But currently my company has proposed to send me to Germany for 1 yr assignment. Can I apply for EC from Germany? and what are the docs. changes required can someone guide me through...

I understand and what generally rules are that you can apply anywhere from the world to BHC provided you have residence/work permit of that country. So you can apply from US for EC and later your wife can apply from Canada.
Thinking low is crime....

Once you get the approval letter in India and you have work authorisation/temporary residence for Germany, you can apply EC from there.

I was told that I need to stay in Germany for atleast 6 months before I can go for EC stamping. Also there will be a lot og Back ground check for this and it is really not suggestable to do this...can you explain what will be the document changes and what other measures need to be taken as per new rules to get the EC

Yes, it would be wise to apply from your home country rather then Germany. The best thing I would suggest that if you want to apply from Germany, give a call to local British consulate in Germany and get the information. They would be right body to feed you with accurate and up-to-date info.

i was gonna say another option could be for you both to apply from canada since that's your homebase anyway - but then realized you'll need your passport to come back for your work in the US... duh!!

i would like to think that if you provide ample proof that your wife is your dependent, then her EC should also be processed in New York (she might have to come over for fingerprinting... not sure). i don't have any personal experience to share w/you regarding dependents but would suggest contacting the NYC BHC regarding this (email usually works).... i just think it should be possible but you never know...

as for your wife joining you three months after you, you can request her EC to be post-dated by three months, if that option is still available. although my understanding is that once one has got the EC s/he can travel any time in that period - so not exactly sure you need to go through this process twice... but pls check w/NYC BHC.
