Skip of 3 weeks due to extenuating circumstances

I got Tier-1 (POST STUDY WORK)IN AUG 2008.
But In October I was unbale to work due to unexpected death of my mother and I went to home country (5 weeks). During this perriod I took holiday wages but still 3 weeks unpaid. I want to apply for Tier-1 (General) . I have read that maternity leave OR adoption leave is acceptable.
My question is that should this period is exclusive from my previous earning of one year. ( I mean May 2008 till May 2009). Should home office give me 3 more weeks for earning.
I hope some body can ascerting my question.

How long your Tier-1 is valid for?

My Tier-1 (Post study work) is valid till Aug 2010.
But I started work full time since MAY 2008 because I was eligible to that and during the period between ( May 2008 to Sep 2008) is utmost important for me becuase I have earned almost 15k. Therefore I don't want to skip this period. My intention to apply for TIER-1 (GENERAL) is MAY 2009.
I hope this clears.

In that case why dont you claim points for whatever you actually earned during May2008 to April 2009? does this change the salary band?

Yes I need three weeks more in 15 MAY 2009 because this will change my salary band. I have to show 32k.
I just need to know WHETHER HOME OFFICE ACCEPT MY extenuating circumstances OR NOT???

In order to help you we have to understand your problem. So dont be irritated (which I think you are as is visible from your capitalized words above) if someone asks you a question.

Now the answer your question is: No

You can claim points for a 12-month period outside of the 15-month period only in very limited circumstances. These are if you have been away from the workplace for a time during the last 12 months because of:
full-time study; or

a period of maternity or adoption-related absence.

The guidelines do not refer to any other circumstances under which you can get a concession from the 15 month window.
