W2 Salary and Paycheck related question

W2 Salary and Paycheck related question

I would be applying from USA for UK Tier1 Visa. Can someone help me find answers to the following questions:

1. Income earnings (mentioned in W2) which are declared in the form to claim points are Gross specific or the net salary(Pay checks) specific for the specified period of time ? Please look at the following scenario of my salary:

Jan 2008 – Dec 2008 i.e Gross Salary (Without Tax deductions) = $49597.50 (35 points earned, I qualify for Tier1) :)
Jan 2008 – Dec 2008 i.e. Net Salary (After Tax deductions) = $22380.90 (5 Points earned, I do not qualify for Tier1) :cry:

2. Would the Immigration Officer consider an authorized leave notice document from my company stating that I was on vacation for a duration of 4 Months (2 Months in India & 2 Months in USA) without any paycheck within the one year considered for declaring my earnings to claim points? I do not have any paychecks for those 4 months. :cry:

3. I do have all paychecks with W2 avaialable for the year 2007, can I claim points for the year 2007 only.

Please advice

1. You can use Gross earnings for claimig the points. Please note that you are running out of time. You can claim earnings for any 12 consecutive month period from the last 15 months to claim points. If you want to use Jan 08 to Dec 08 then you need to apply NOW!!

2. Thats fine. The start date and the end date of the earnings claim period can not be separated by 12 months. So if the 4 months fall within the 12 month period and you are claiming '0' earnings for the period, you should be fine
3. No you cant as it falls outside of 15 months period from the date you apply.

Thanks Push_hsmp Unfortunately, I cannot apply now. I am planning to apply in July since I have to maintain funds for 3 consecutive months starting from this month. I am still working and do have paystubs for Jan, Feb and March in 2009 and hopefully will have paystubs till June 2009.

Scenario 1:
Can I claim points from Jan 2008 till June 2009 and mention to the Immigration officer that my W2 is only for Jan 2008 - Dec 2008 and other 6 months earnings are based out of payslips in 2009 and there is no W2 for this duration as of now.

Scenario 2:
Can I claim points from June 2008 till June 2009 and mention to the officer that my W2 is for Jan 2008 - Dec 2008 which also covers the 6 months in 2008 and other 6 months earnings are based out of payslips in 2009 and there is no W2 for this duration as of now.

Please advice. I am realy getting nervous as Tier 1 was my last option. :? :cry:

1. You need to read the guidance notes very carefully because the questions you have asked are very basic and show that you haven't done so. I am not trying to deride you but sort of warning you. PBS application is judged based on compliance with the conditions set in the guidance notes.

2. You can not claim for Jan 08 to june 18 because it is more than 12 months and outside of 15 month period of consideration

3. You can cerainly claim for July 08 to June 09 (12 months period) and instead of W-2 provide 12 month salary subs + Bank statements showing regular credit of salary into the account.
