ILR - discretion re time outside UK in year pre applying?

Post by rebhobbs » Fri Jul 17, 2009 12:47 pm

Having lived here 5 years under HSMP - I'm eligible to apply for ILR settlement. However in the last 12 months, I had to spend 140 days out of the UK - does this mean I will be turned down? or is there discretion as to the days out of the UK rule?

Also - I was recently made redundant - and I notice the application form asks whether you're employed, and how you can prove sufficient funds to avoid recourse to public funds - I have a decent redundancy payout now, would that suffice?

I'd be very grateful for any advice.
