Marriage on Tier 1 visa with a Student Visa holder?

I am a foreigner on a Tier1 Visa that expires 2yrs from now, Can i get married to someone who is on a student visa? Is it legal.
Do we both have to get COA from Home Office ?

Please advice on the fees etc.
