Tier 1 Gen Visa, maximum how long we can stay out of country

Post by tuliprose » Fri Aug 28, 2009 9:53 pm

Hello mates,

One of my close friend got his Tier 1 General visa in July and he is on holidays now to back home. He got some problems in family and wants to stay there for now.

My question is, maximum how many months he can stay there?
And would there be any effect on his further extention of Tier 1 or Indefinite leave or remain?

Regards,
Tuliprose

Thanks for your reply Vinni. I gone through the guidance and it says:

Annex A – Calculation of the five year period for settlement
In assessing whether or not an applicant has fulfilled the requirement to have spent five years in continuous residence in the UK, short absences abroad, for example for holidays (consistent with annual paid leave) or business trips (consistent with maintaining employment or self-employment in the United Kingdom), may be disregarded, provided the applicant has clearly continued to be based here.

So if my friend stay there to discuss projects with softwares houses for his UK self-employed business, is it okey to stay there more than 3 months at time??

I guess so, provided he can satisfy the case worker.
