Tier 1 application for partner who is curretnly as dependant

Tier 1 application for partner who is curretnly as dependant

Hi all,
Can my partner apply for independent Tier 1 application while being dependent on my visa currently according to the new tier application that is in place from Oct 2009?

From UKBA web site
You can apply under the highly skilled worker category now if you are:

already in the United Kingdom with permission to stay (known as 'leave to remain') in an immigration category that allows you to switch into the highly skilled worker category;


So essentially I am seeking does my partner falls in 'an immigration category that allows you to switch'.

If your partner want to switch from dependent to Tier-1(main applicant) he/she has to go back to the home country and apply as fresh applicant.
