Will new rules apply to those who entered in 2009

Post by Jama » Sat Feb 27, 2010 10:23 pm

Dear All,

I entered the UK in January 2009 as Tier 1 (General) migrant. I wonder will the new rules apply to me as well? Shall I do my FLR in 2 years time? What will happen further? I can not understand to be honest with you how it will all work from now on. Need your advice.

Many thanks,

Jama

when you apply for extension, you must satisfy the rules current at the time of application. So yes, you might be subjected to abiding by new rules.

The rules (based on which you were granted leave under tier 1) is only relevant until your current leave expires. So,lets say, if your tier 1 visa is expiring in July 2010 and new rules are introduced in May 2010, you only need to be concerned with old rules until the day your leave expires but when you make an application, e.g. for extension, in July 2010, you must satisfy new rules.

Hope this is helpful reply.
