tier 1 general

Post by similarry » Wed Sep 01, 2010 8:10 pm

I am currrently in the uk with spouse and 3 children. My wife was a student and she is now on post study work visa.Myself and children are all dependants of her.We have been in the uk for about 5 yrs.
I want to apply for tier 1 on my own right and have been advised to go out of country to nigeria to apply. This is because i am very economically active and i meet all the criteria.
Question -Im applying alone in nigeria as main applicant in tier 1 general-how much funds would i need and will i have to show evidence of funds for my wife and children even though they are not applying with me at the present moment. And if i have to show evidence of funds, would it be 1600 or 533.This is because the rules state that 533 per dependant if main applicant has been in the uk for more than 12 months.

2nd question is will i be subject to the interim limit in place?

Thank You

1. Yes, you need to apply from Nigeria.
2. EC applications (outside the UK) require the applicant to show evidence of GBP 2800 for self and 1600 for each dependent (if dependents are applying at the same time as the main dependent).
3. Applications submitted outside the UK are subject to the interim cap.

This said, do remember that your spouse will not be allowed to change from Tier 1 (PSW) migrant to dependent of Tier 1 migrant from within the UK. Spouse and children will also need to apply for EC as dependents from Nigeria, as and when they wish to change immigration categories.
