In-Country Application Switching Tier 2 to Tier 1(General)

Hi,

I am currently in UK on Tier 2 (Intra company transfer) established staff category. (Just arrived in Oct 2010 and will be here for next 4 months)

I have also came to UK on similar visa in Oct 2009 for 4-5 months on secondment.

I am still employee of Indian Company and getting full salary in India in bank account in India.

In UK, I am just getting a small per diem (£15 per day) and accomodation and travel provided by company. I am not getting any salary in UK & no payslips etc

For the previous earning assessment, I can only claim my salary paid in India. ( approx 7 lacs). converted in GBP = around £10000.
If I take the uplift multiplier, then the converted will be approx £55000 and I will get 35 points.

I have read multiple posts here which says that if the person is in UK then uplift ratio is not allowed.

But it doesnot seems to be logical for cases where the person is not paid in UK.

Can anyone help pls.

Well, it's not UKBA's fault if your employer sends you to work in the UK but pays your salary as per home country standards in the home country. Their profits will go down if they were to pay employees like you UK level salaries in the UK!

When physically present in the UK, you cannot use uplift ratio to income earned, irrespective of the country in which such income may be credited.

In last 12 months, I was physically in UK for only 4 months (though my VISA was fr 7 months)

Oct 09- Jan 2010 - was in UK
Jan 2010 to Sep 2010 - was in India
Oct 2010 - now - in UK

In that case, can I uplift my Indian salary for another 8 months (if not for all 12 months)

Personally, I'd be unhappy about being paid Indian wages to work in the UK!
