Switching from Tier 1 to Tier1 dependent

Switching from Tier 1 to Tier1 dependent

Dear All,

Wish you all a very happy new year 2011. I have a query regarding tier 1 visa and I seek your assistance for sorting it out. I and My husband both have our own tier 1 visa (we are not dependent to each other). Now it’s the time for extension and I would like to change my husband's visa to a dependent visa ( dependent to me)

Could experts and senior members suggest me if changing from tier 1 to tier 1 dependent is going to be in country application? Or my husband must return to home country and to be applied from home country? Could you also direct me to any pointers in ukba site about this?

Thanks for the reply. As per the link you pointed out http://www.ukba.homeoffice.gov.uk/worki ... dantroute/ I could see "a work permit holder." in the list (to switch to dependent inside country).

Is tier 1 not categorized under Work Permit? Can you clarify please?

No work permit is pre PBS.

After a deep thought my husband has decided to go back to home country and apply for dependent Visa. Perhaps, I have few questions before we conclude on the decision. can anybody share your views and experience on the below questions?

1. As he is holding TIER 1 general now. Do my husband need to submit the tax returns and payslips while applying for dependent visa? As he is working as a contractor I dunno what will be his Job situation while applying dependent visa.

Basically I would like to know If HO treats Switching from Tier1 to dependent the same way as a Fresh dependent visa? Do we have to submit any additional documents as he is in Tier 1 now.

2. How the employers treat Tier 1 and Tier 1 dependent? Are these 2 Visa holders given the same preference ? I know both Visa holders has the right to work. But if there are 2 candidates with same knowledge and profile. Do employers prefer Tier 1 or dependent candidate?

I am worrying if he is going to lose the chance because of switching to dependent. Also some days later, I will stop working (temporarily) and he (dependent) will be working. Is that a problem.

Can anyone share your experience and views please.

There's no definite answer to such questions. In a perfect world, it shouldn't matter, but the world is not perfect. Differs from employer to employer (e.g. - for some employers the remaining duration of applicant's visa validity is a key eligibility criteria and for some it doesn't matter).

As long as your temporary out-of-work period doesn't affect your eligibility for an extension, there should be no cause for worry.

I just need one more clarification with regards to switching from Tier 1 to Tier 1 dependent,

Suppose, If my husband travel next month to India for switching (though his Tier 1 VISA is valid till July 2012). By any chance if his Tier 1 dependent VISA get refused can he be able to travel with his existing Tier 1 as it is Valid till July 2012.

I would like to know if there is any rejection in Tier 1 dependent will affect his Tier 1? will it leads to cancellation of Valid Tier 1?

Please can someone help.

Switching refers to "changing immigration category by applying from within the UK". One cannot "switch" from Tier 1 to dependant of Tier 1.
