Criminal/ Civil Offence for Tier 1 visa Extension

Hello,

I am on Tier 1 Visa and my extension is due in coming June 2011. My question is about Criminal/ Civil Offences. I used to have a car and my friends were also driving that car. Car was on my name. They got penalties from Police and Local council. But they did not inform me. They were living with me on the same property and studying in a uni. I am working full time and Police/ Local council sent me letters for these penalities and my friends put them in the bin. (As I go to home in the evening around 8 or 9 pm). Then Police and Local council took me the courts. (1-Police to local megistrat court and 2- Local council to Northampton bulk county court). Court sent me few letters and only got one. I paid the police tickets in the local court and Local councils in the local council payment systems. Even though they registered my name in the northampton county court. I wrote letters to local courts and police. Police said that they have entered the notes on the cases and the same thing local councils said (two councils).
In a nutshell
1- Two tickets were issued by local police for wrong parking. paid in the court.
2- Two tickets issued by local council for wrong parking. (registered in northampton bulk county court). paid to local councils
3- One ticket was issued by a cctv department of a council for driving in a wrong lane. I think it was a bus lane. registered in northampton bulk county court and paid to local council.
In all above cases I was not the driver, It was my firends. As I work in other city and travel by train. never traveled by car.
In all above cases I did send letters every where (To councils/ police and courts). They added notes on the files but they said they are not going to remove my name.

Now I need your advise. Please could you tell me are these cases going to affect my Tier 1 visa extension? Do I need to declare these on the application? or is there any thing else I need to do i.e to take these cases further to other courts?
I would appreciate your advise?

If you was not guilty then you must have said this in court rather than paying straightaway. As an owner your responsibility was to inform police/council about drivers. In court, you could have explained situation without being emotional as your friends were not doing any good to you. Since you have accepted all these and paid fines then your name will be there. I don't know how to get it correct. Probably re-opening those close cases will help but only a solicitor can advise on these.

Since you were taken to court , you are liable to declare in application .

Since your friends had been disloyal to you .
You should have told the court that your room mates took the car without your knowledge as the key is in a shared room and you were not even aware that they took the car ... check with a solicitor if they can see any light on this ...

wrt to ur extension there are mixed cases... one of my friend got extended inspite of parking offences being served @ court but another guy was rejected but his was not parking but drunk driving .... But dont take chance as yours is a case of disloyalty by freinds and you can think of clearing your names ...

In future be strict with your car mate . I dont even give my car to my bro fearing such issues and usually he drinks a bit in parties ....

Couple of things I would like to add.
1- I have informed the police/court and Local council that I was the owner but my friends were driving the car. They are saying that as the cases have been closed so no further communication will be accepted.
Please note: My friends were registered on my insurence as second drivers on the same car.
2- I requesteed subject access from police and got no records against my name.
Any way I will speak to Solicitor and see what they say.

In the mean while, please could you add more or advise?

I appreciaite your replies.

Any one knows if some one had applied for Tier 1 Visa with similar types of criminal/ civil offences and what was the outcome? I read about UKUK friends. I think it is better to declare them in the application along with a covering letter.

Hello All,

I have just discussed this issue with a Lawyer. He said Car parking tickets are not big issue. It wont affect my extension but I have to declare them in the application. because these were issued in court.
Lets hope it wont affect my extension.
