Applying 21 month earlier

Post by sharjeelpk » Fri Mar 25, 2011 11:34 am

Hi,

I am sending my 2nd extention application today 21 month earlier because I am short of 8 days to complete my physical stay in Uk for ILR.
1st Extension (from HSMP to Tier1) I applied 1 year earlier my visa expiry and got 3 year extension. now I just need 8 days extention and I am sending it today . so do anybody think its a wrong decesion to do this or not ? my current visa expiry date is 03/01/2013 so if they give my extention from today for 2 years which means 25.03.213 (It covers my 8 days ).
I dont want to waste extra money after april and they may comeup few more changes after that.
Any comments please.

According to my knowledge, you are entitled to have one 2 years extension at the end of your current leave i.e., 03/01/2013. Also, the new rules say that people who are already on Tier 1 will be allowed to complete their route on the basis of rules at the time of their first Tier 1 application (Transitional arrangements)

I think you will be fine even if you apply later. However, you need to have an extension for ILR anyway, so does not matter if you apply now or later.

Regards

You are right but after few months I will lose my age points and after april I have to pay more for extention as I am applying with my 3 dependants as well.
I saw the case who applied 18 months earlier for his 2nd extention and got it as he alos required a month only for his ILR.

What was your date on entry in the UK (as a Tier 1 General) migrant or, if you applied from within the UK, the date leave to remain was issued?

My dates are as follows

HSMP Visa start 03/01/2008 till 03/01/2010
Entered in UK 11/02/2008 (around after 40 days )
HSMP extention applied july 2009 (six month earlier )
got extension in tier 1 from 03/01/2010 till 03/01/2013
now send documents on 18/03/2011 for tier 1 extention (18 months earlier) as I just need few days to gualify for ILR and they are increasing the application fee plus I will gonna lose age points if I wait and apply later.

Looks like you may have unnecessarily wasted money on an early extension.

1. See From 06-Apr-11.
2. Alternatively, see also possible solution.
3. From 06-Apr-11, points for age will depend on the date of the first application (in your case, date of HSMP approval application in 2007) - which remains constant, no matter how old you grow.
Age wrote:If the applicant was first granted leave in the categories of Highly Skilled Migrant, Writer, Composer or Artist, Self-employed lawyer or Tier 1 (General) Migrant and has not been granted leave in any category other than those listed here since the first grant of leave, points will be awarded based on the applicant’s age at the date of the application for that first grant of leave.

You are right but these bits are not mentioned on the form plus I applied because it says "Casewoker may consider" but not mentioned anywhere "Caseworker should consider" I hope you know what I mean, I cant trust on thses case workers because if you give same case to few different case workers then I am sure all of them comes up with different results, they are not trained enough secondly I have to apply now or later so I thought why not apply now because fee is incresing in appril and I am sure it will be duble till next april.
thnaks for your reply.
