Query - stay after rejection of tier 1 extension

Hi ALl,

I am positng this query for a freind of mine.
Can anyone suggest when you apply for tier 1 extension and if it gets rejected for some mistake or unreasonable reason(hypothetically) and by the time you get your application back your leave also expires than what is your immigration status at that point? do you have to leave country immediately or you get some time to appeal?

for eg. if visa expires on 30 nov and home office replies on 1st decemeber with refusal with some mistake of case worker, then what are the options at that point do you have to leave country straight away or do you get some time to make appeal?

is there any guidance on this that we can refer to? i was searching on UKBA but couldn't find much detail, m sure there is something can someone guide me to the right link?

I'd be interested to know too. From what I heard from others you are given about 10 days in which to appeal your refusal, otherwise then you must leave the country after this time or when your current leave expires.

Surely if it is caseworker's mistake, I would challenge that decision right away. What does your friend's refusal letter say? Does it not mention whether they have appeal rights or not?

so when you get ten working days to apply it means that you ca continue to work or you have to leave your employment?

basically i didn't quite understand this bit? does it mean you can continue working when 3c is applicable, as it says conditions attached to the original limited leave?
my apologies it might be very simple, i just seems to have gotten confused myself. thanks

"Where an applicant's leave has been extended by sections 3C or 3D and the
applicant wishes to work or set up in business pending a decision on the application,
our advice should be that the section extends the time limit and maintains any
conditions attached to the original limited leave.
A person whose previous leave was subject only to a time limit, ie. Code 1, may work
or set up in business while the application is under consideration, but should be
advised that this does not necessarily mean that an application to remain for such a
purpose will be granted."
