Do i need an extension or can apply ILR

Hi,

I was granted hsmp in May 2008 but I entered UK in sep 2008 as i had to undergo a surgery and wasn't well for that period. I am currently on tier 1 gen valid until may 2013. My query is can this condition help me evade another extension and can i apply ILR in may 2013.
