Family visit overlapping with visa expiry

Post by ashdaone1 » Wed Jan 25, 2012 10:52 am

Hi All,

Please can someone help with my peculiar query?

I am inviting my family to come and visit me this June. They can only come between 1st June - 1st July 2012 as my sister's college's vacation fall during that period.

Now, my current Tier1 visa expires on 9th June 2012. My renewal is a straightforward case, but as per the UKBA's guidelines, I can't renew it before 9th May (for the fear of falling short of ILR qualification period).

My question is, if I ask them to apply under family visitor category, will they get a visa only till the 9th of June? In that case, they will be visiting UK only for 9 days, which is pretty useless.

Also, I read in the forum elsewhere, that a family visa is anyway for 6 months always, so I should not worry about that.

Please advise, what would be my best course of action?

Thanks,
Ash

Visa expiry shouldnt really matter, if your leave expires while your application is being processed by HO, you automatically have leave until they decide your application under Section 3C of the Immigration Act

http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

Sponsoring your family also shouldnt be a problem, just apply as normal

Thanks very much for your information, however, I am more concerned about the length of the visa that would be given to my family?

If my visa expires on 9th July (which, I will renew of course), will they be granted a leave till the 9th as well or will they get the standard 6 months leave?

Reason why I am worried is that if they get a leave till only the 9th, they will have only 9 days to come and visit me as they cannot leave before 1st June.

Any input will be much appreciated. Thanks.

Well what i meant to say was visitor visa doesnt depend on when your visa is expiring. better double check by calling HO at 9 AM on a working day
